The minimum amount of auto insurance that’s required by law in Texas is $30,000 for injuries per person, $60,000 per accident and $25,000 for property damage. Drivers who are underinsured have a bit of coverage in place, but not nearly enough to reimburse you for auto repairs and medical bills. 

Uninsured means that they have no type of insurance available. Without uninsured coverage in your own policy, the best approach is to either take them to court or cover the costs yourself. If you take them to court, there is no guarantee they even have enough money to cover the costs if you win. 

Why Is Additional Coverage a Good Investment? 

Including underinsured and uninsured coverage is the easiest way to maintain a level of protection. By the time you find out that the other driver doesn’t have insurance, it’s too late to update the policy. Plus, it also applies when you’re outside the vehicle and will provide for any injuries that are sustained. 

How to File a Claim

When dealing with an underinsured driver, you’ll have to secure a “consent to settle” from their insurance agency. This recognizes that they’re willing to accept responsibility for the accident and prevents your company from coming after the at-fault party. 

Send a copy of your declarations page detailing the amount that’s available along with the release to the other party’s carrier. Sign the release and provide records of the damage and medical bills to the underinsured for approval.
