Buying, selling, and gifting guns across state lines is a common practice referred to as a firearms transfer. While many people complete these transactions every day, the process can be confusing if you’re looking to transfer ownership of a gun for the first time. The law requires that anyone changing possession of a gun from one state to another must go through a firearms dealer with a Federal Firearms License (FFL). The following information provides an overview of how to do this correctly in Illinois.

FOID Card Requirements 

Under Illinois law, residents who wish to purchase, possess, and transport guns need a Firearms Owners Identification card (FOID). The FOID is issued by the Illinois State Police once the applicant has cleared state and federal background checks. The card will remain valid for 10 years and must be shown before obtaining a firearm.

State law also requires gun buyers to go through a 72-hour waiting period for both long guns and handguns. This legislation allows people who might be considering acquiring a gun for criminal purposes enough time to think rationally about their decisions. Additionally, before a transfer can be finalized through an FFL dealer, a background check will need to be conducted and ATF form 4473 must be filled out. Buyers should be prepared to provide their identifying information, FOID number, and a description of the gun being purchased. 

Choosing an FFL Dealer 

In most cases, it’s easiest for the buyer to select an FFL dealer and have the shipping instructions sent to the seller. They should let the dealer know they’ll be receiving a transfer and go in to have the background check done as soon as possible. The waiting period won’t begin until all your paperwork is in. Once the FFL dealer has checked in the shipment, it will be available for the buyer to pick up with proper identification.
