In order to possess a gun and ammunition in the state of Illinois, individuals must be issued a Firearm Owners Identification (FOID) card. Illinois laws, however, are strict, and several groups of people are prohibited from owning guns if they reside within the state.

What Disqualifies You From Gun Ownership in Illinois?

1. Criminal Record

Individuals convicted of a felony or a misdemeanor for domestic violence are not permitted to obtain a FOID card. The same applies to anyone who has a restraining or protective order against them that directly states they may not possess a gun. If a person is found in violation of these federal crimes, they may be ordered to pay a fine and could face jail time.

2. Mental Health

Neglecting to provide truthful answers on this application, such as denying an arrest history, disqualifies the person from owning a gun in the state. The applicant’s card, if issued, may be seized in this situation.

4. Various Disabilities

Certain types of disabilities may also disqualify a person from gun ownership. Those with intellectual and developmental disabilities that occur before 18 years of age and result in significant impairments that are expected to continue may not apply for a FOID card.
