What Is a Pre-Sentence Investigation Report (PSIR)?
When a person is convicted of a felony or misdemeanor, a judge will sometimes request a pre-sentence investigation report (PSIR). This document includes detailed information about the convicted individual’s personal life to help the judge decide on an appropriate sentence. Here’s an overview of the reporting process and how a defense attorney can help improve its results.
What Happens During a PSIR Investigation?
In the weeks between a conviction and sentence hearing, a social worker or probation officer will research various elements of the defendant’s life, including their educational background, employment history, and prior criminal record (if one exists). They will interview friends, family members, and acquaintances to get a picture of the defendant’s personality and overall character, as well as get an impact statement from the victim or victims of the crime they committed. They will also conduct an interview with the defendant.
What Happens During the Interview?
The defendant will be asked questions about various aspects of their life, including family relations, finances, mental and physical health, work history, and military history. They will also be given the opportunity to explain why they committed the crime and why a lenient sentence would be appropriate.
Whenever possible, defendants should bring documents to support their claims of character, such as written recommendations from former employers or commendations from military service.
How Can a Defense Attorney Help?
A defense attorney cannot be present during a PSIR interview. But they can influence the results of the report by making sure their client’s most positive qualities are incorporated into it. For example, if the defendant is trying to better themselves by going to school or enrolling in an addiction treatment plan, their attorney will make sure this information is included in the report.
A lawyer can also help their client craft a convincing written statement arguing for a lighter sentence, as well as coach them before the interview to make sure they don’t say anything that could be held against them.
